Terms & Conditions

These terms govern use of opsbreeze.com and describe the rules that apply to OpsBreeze website interactions, communications, demonstrations, and SMS messaging. Separate customer agreements may apply when you purchase or use paid OpsBreeze services.

1. Acceptance of these terms

By using opsbreeze.com, submitting a form, requesting a demonstration, or otherwise interacting with OpsBreeze through this website, you agree to these Terms & Conditions and our Privacy & Communications Policy. If you do not agree, do not use the website or submit information through it.

2. About OpsBreeze

OpsBreeze provides business-process, lead-handling, communications, automation, AI-assisted receptionist, customer follow-up, membership-program, and related operational services for local service businesses. Website descriptions are informational and may not reflect every feature, integration, limitation, or configuration available to a particular customer.

3. Website inquiries and demonstrations

Information provided through audits, calculators, examples, demonstrations, or AI-assisted conversations is intended to help businesses evaluate possible workflows and services. Demonstrations may use simulated scenarios and do not create a customer relationship or guarantee that any particular result, integration, appointment, revenue level, lead volume, or business outcome will occur.

4. Paid services and separate agreements

Paid OpsBreeze services may be governed by an order form, proposal, service agreement, statement of work, subscription terms, or other written agreement. If a separate written agreement conflicts with these website terms regarding a paid service, the separate written agreement controls for that service.

5. Pricing and service availability

Website pricing is provided for general reference and may change. Setup fees, usage-based charges, third-party costs, taxes, custom integrations, implementation work, and other charges may apply depending on the service. A quote, proposal, or checkout page presented for a specific purchase controls over general website pricing for that transaction.

6. SMS messaging terms

If you voluntarily opt in to receive text messages from OpsBreeze, you may receive customer-care messages related to an inquiry, requested demo, Missed Lead Audit, appointment, or other service-related conversation. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of purchase.

You may opt out at any time by replying STOP. After you opt out, you may receive one final confirmation message. For assistance, reply HELP or visit opsbreeze.com. Supported carriers are not liable for delayed or undelivered messages.

Do not provide sensitive credentials, payment-card details, Social Security numbers, or other highly sensitive information by text message unless OpsBreeze specifically provides a secure method for doing so.

7. Communications consent

Providing a phone number does not by itself authorize marketing text messages. Where consent is required, OpsBreeze will request it through an appropriate opt-in method. If OpsBreeze later offers promotional SMS programs, any additional consent required for those messages will be requested separately.

8. Acceptable use

You may not use the website or OpsBreeze communications channels to violate law, impersonate another person or business, transmit malicious code, interfere with website operation, attempt unauthorized access, abuse automated systems, or submit fraudulent, deceptive, or unlawful requests.

9. AI and automated communications

Some OpsBreeze interactions may be handled or assisted by automated systems or AI. These systems may summarize information, answer common questions, collect details, or assist with scheduling and follow-up. Automated responses can be incomplete or inaccurate, and important business decisions should be independently reviewed when appropriate.

10. Third-party services and integrations

OpsBreeze may connect with or rely on third-party services such as communications, hosting, scheduling, payments, analytics, customer-management, or other business software. Third-party services may have their own terms, privacy policies, fees, availability, and technical limitations. OpsBreeze is not responsible for changes, outages, or acts of third-party services outside our reasonable control.

11. Intellectual property

The OpsBreeze name, website content, branding, designs, workflows, documentation, and other materials provided by OpsBreeze are owned by OpsBreeze or its licensors, except where otherwise stated. You may not copy, resell, publish, or commercially exploit those materials without permission, except as allowed by law or a separate written agreement.

12. Disclaimer of warranties

To the extent permitted by law, the website and free demonstrations are provided on an "as is" and "as available" basis. OpsBreeze does not guarantee uninterrupted availability, error-free operation, specific lead conversion, customer retention, revenue, savings, or other business outcomes.

13. Limitation of liability

To the extent permitted by law, OpsBreeze will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or free demonstrations. Any liability relating to paid services may be further addressed in the applicable customer agreement.

14. Changes to these terms

OpsBreeze may update these Terms & Conditions as our services or applicable requirements change. The effective date at the top of this page identifies the current version. Continued use of the website after an update constitutes acceptance of the revised website terms.

15. Contact

For questions about these terms, contact OpsBreeze through opsbreeze.com. For SMS assistance, reply HELP to an OpsBreeze text message. To stop SMS messages, reply STOP.
